The undersigned wishes to acquire and use a key, gain entrance to Crystal Park Development Corporation facilities in the Village of Silver Lake, Ohio. The key is to be utilized to access Crystal Lake fishing boats, lake, basketball and pickleball courts during certain times specified within the rules, terms and conditions specified by Crystal Park Development Corporation Conditions and Terms of Gate Key Acquisition and Use, and any applicable rules and regulations as may, from time to time, be disseminated by the Board of Directors of the Corporation.

The undersigned also acknowledges that he or she fully understands the inherent risks and dangers of on water activities such as boating/fishing and on land activities such as basketball and pickleball, especially during off-hours of operation and without supervision, and is familiar with the lake and its facilities. The undersigned does represent to the Board that he/she can and will exercise water safety including compliance with the rules and Regulations of Crystal Lake, the Terms and Conditions of Key Acquisition and Use and the Laws of the State of Ohio and has the requisite abilities to enjoy safely the lake facilities at Crystal Lake and will follow all applicable rules and exercise safe play while utilizing the courts.

The undersigned in consideration of being allowed to acquire and use a key to gain access to the Crystal Lake property and facilities in the manner described above and other valuable consideration, hereby voluntarily assumes all risk of accident or damage to my person or property attendant to the use of Crystal Lake property and facilities pursuant to the issuance of the subject key, and for myself, my heirs executors, administrators and assigns does hereby release the Crystal Park Development Corporation and its directors, officers, agents and employees from every claim, liability or demand of any kind for or on account of any personal injury or damage of any kind sustained by himself herself during or related to such use, even if caused by the negligence of the Crystal Park Development Corporation, and its directors, officers agents, employees or otherwise. Such release contemplates any damages associated with access to any Crystal Lake facilities under the circumstances described herein, and specifically contemplates the kind of damages which naturally flow from accident or injury while boating on a lake, such as damages from contact with the water (including but not limited to personal injury or drowning), and while utilizing the courts for sports.

The undersigned agrees for myself, my heirs, executors, administrators and assigns, to indemnify, save and hold harmless the Crystal Park Development Corporation, its directors, officers, agents and employees from any and all losses, claims, actions or proceedings of every kind and character which may be presented or initiated to recover money, property or damages for any injuries to persons, or injurious results, or any damages to property suffered during the use of Crystal Park Development Corporation facilities by the undersigned or any other person by or through the authorized or unauthorized use of the subject key, and including all such damages claimed by the undersigned or any other person gaining access and use of our facilities, directly or indirectly, by and through the authorized or unauthorized use of the subject key. Such indemnification applies even if the Corporation, directors, officers, agents, and employees are negligent in any way related to the use of facilities by persons who gained access by or through the issuance and authorized or unauthorized use of the subject key, directly or indirectly. This indemnification contemplates any damages associated with access to any Crystal Park Development Corporation facilities under the circumstances described herein, and specifically contemplates the kind of damages which naturally flow from accident or injury while boating on a lake, such as damages from contact with the water (including but not limited to personal injury or drowning) and while utilizing the courts for sports.

The undersigned acknowledges receipt of the Crystal Park Development Corporation Gate Key Acquisition and use and agrees to comply strictly with such terms and conditions.

If any provision of this Agreement in whole or in part shall prove to be invalid for any reason, each invalidity shall affect only the part of such provisions which shall be invalid, and no other portion of this Agreement shall be invalidated thereby.
